Welcome to Fitscape, the RPG fitness tracking app that transforms your health journey into an epic adventure. These Terms of Use ("Terms") govern your use of the Fitscape mobile application and related services (collectively, the "Service") provided by Coe Code LLC ("we," "us," or "our").

By downloading, installing, or using Fitscape, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

App Description and Features

Fitscape is an iOS application that gamifies health and fitness by integrating with Apple HealthKit to transform your real-world activities into RPG gameplay elements:

• Character Progression: Level up stats (Strength, Constitution, Dexterity, Intelligence, Wisdom, Charisma) through real exercise
• Dungeon Exploration: Discover and conquer dungeons through real-world movement (every 400m)
• Equipment System: Earn gear with varying rarities through gameplay achievements
• Quest System: Complete daily and weekly challenges based on your fitness goals
• Social Features: Connect with friends, join guilds, and compete on leaderboards
• Stamina System: Recovery based on sleep quality and duration
• Health Integration: Comprehensive metrics including steps, workouts, sleep, and heart rate

User Eligibility and Account Requirements

Age Requirements

You must be at least 17 years old to use Fitscape. The app requires access to health data and contains features designed for adult users.

Account Creation

• You must provide accurate and complete information when creating your account
• You are responsible for maintaining the confidentiality of your account credentials
• You must have a compatible iOS device (iOS 17.0 or later)
• Each user may only maintain one account

Health Data Requirements

Fitscape requires access to Apple HealthKit to function properly. You must grant appropriate permissions for health data access including steps, workouts, sleep, and heart rate data.

IMPORTANT: Fitscape is for entertainment and fitness motivation purposes only. It is not intended to provide medical advice, diagnosis, or treatment. The app's features, recommendations, and insights should not replace professional medical advice.

Health Data Processing

• Your health data is processed locally on your device using Apple's HealthKit framework
• Only computed game values (not raw health data) are synchronized with our servers
• You can revoke health data access at any time through iOS Settings
• We do not provide health recommendations or medical guidance

Use at Your Own Risk

By using Fitscape, you acknowledge that physical exercise and activity carry inherent risks. Consult with a healthcare professional before beginning any fitness program. We are not responsible for injuries or health issues that may result from using the app.

User Conduct and Community Guidelines

Acceptable Use

You agree to use Fitscape responsibly and in accordance with these guidelines:

• Use the app for personal fitness motivation and entertainment
• Respect other users in social features and interactions
• Provide accurate information about your fitness activities
• Report bugs and provide constructive feedback

Prohibited Activities

• Cheating, hacking, or manipulating game mechanics
• Using automated systems or bots to generate false activity data
• Sharing inappropriate content or engaging in harassment
• Attempting to reverse engineer or modify the app
• Violating any applicable laws or regulations
• Interfering with other users' experience or app functionality

Social Features

When using guilds, friend connections, and leaderboards, you agree to maintain a respectful and supportive community environment. Harassment, bullying, or inappropriate behavior may result in account suspension or termination.

Beta Program Terms

Beta Access

If you participate in the Fitscape beta program, additional terms apply:

• Beta software is provided "as-is" and may contain bugs or incomplete features
• Your beta access may be terminated at any time without notice
• Beta data may be reset or lost during updates
• You agree to provide feedback and report issues
• Beta features are confidential and should not be shared publicly

Feedback and Testing

By participating in the beta program, you grant us the right to use your feedback, suggestions, and bug reports to improve Fitscape without compensation or attribution.

In-App Purchases and Subscriptions

Premium Features

Fitscape may offer premium features through in-app purchases or subscriptions:

• All purchases are processed through the Apple App Store
• Prices are subject to change with notice
• Subscriptions auto-renew unless cancelled
• Refunds are handled according to Apple's refund policy
• Premium features may include additional equipment, customization options, or advanced analytics

Payment Terms

Payment for premium features is due immediately upon purchase. You are responsible for all charges associated with your account, including those made by authorized users.

Intellectual Property Rights

Our Rights

Fitscape and all related content, including but not limited to:

• Software code and algorithms
• Pixel art, graphics, and animations
• Chiptune music and sound effects
• Game mechanics and systems
• User interface designs
• Character designs and equipment artwork

All content is owned by Coe Code LLC and protected by copyright, trademark, and other intellectual property laws.

Your Rights

You retain ownership of your personal data and user-generated content. By using Fitscape, you grant us a limited license to use your data solely for providing and improving the service.

Service Availability and Modifications

Service Availability

We strive to provide reliable service, but cannot guarantee uninterrupted availability:

• Service may be temporarily unavailable for maintenance or updates
• We do not guarantee compatibility with all devices or iOS versions
• Internet connectivity is required for certain features
• Third-party services (Apple Health, Firebase) may affect functionality

Modifications

We reserve the right to modify, suspend, or discontinue any aspect of Fitscape at any time. We will provide reasonable notice of significant changes when possible.

Account Termination

Termination by You

• You may delete your account at any time through the app settings
• Deleting your account will permanently remove all associated data
• Uninstalling the app does not automatically delete your account

Termination by Us

We may suspend or terminate your account for violations of these Terms, including:

• Cheating or manipulating game mechanics
• Harassment or inappropriate behavior
• Violation of community guidelines
• Fraudulent activity or chargebacks
• Extended inactivity (after 2 years)

Limitation of Liability

IMPORTANT LEGAL NOTICE: To the fullest extent permitted by law:

• Fitscape is provided "as-is" without warranties of any kind
• We are not liable for any injuries, health issues, or damages resulting from app use
• We do not guarantee the accuracy of health data processing or game calculations
• Our total liability is limited to the amount you paid for premium features (if any)
• We are not responsible for data loss, device damage, or third-party service failures

Some jurisdictions do not allow limitation of liability for personal injury or certain damages. In such cases, our liability is limited to the extent permitted by applicable law.

Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your personal and health data. The Privacy Policy is incorporated into these Terms by reference.

Governing Law and Disputes

Governing Law

These Terms are governed by the laws of the State of Montana, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of Fitscape will be resolved through:

• Good faith negotiation between the parties
• Binding arbitration if negotiation fails
• Arbitration conducted in Missoula, Montana
• Class action lawsuits are waived

Changes to Terms

We may update these Terms from time to time to reflect changes in our service or legal requirements. Material changes will be communicated through the app or email. Your continued use of Fitscape after changes constitutes acceptance of the updated Terms.
